Your real estate agent must inform you that you receive discounts, commissions or discounts they receive in connection with any work they do for you. The only great advantage for an open list is that the owner probably pays only one sales brokerage commission, which represents about half of the typical fee. This is due to the fact that the owner is not represented, so your agency agreement will remain in effect until the date it ends, unless you put it in place. While only one agent can register you, your contract is between you and the agent or agency they work for. Under the terms of the agency agreement, any agency agent can try to sell it once you have listed your property. If you decide to terminate the agency contract, seek advice from your lawyer first. They must inform the Agency and the notice should be set out in the general agency agreement. The notice period is provided to allow the Agency to conclude the initiations before the end of the contract. If you are not the sole owner of the property, either all owners must sign the agency contract or you must prove that you have the right to sign for all other owners. (You must provide written confirmation to the agent, for example. B a power of attorney, a decision on directors, company minutes or a court document.) Finding the right real estate agent can be difficult, so some providers prefer to have an open list, as this allows them to work with multiple agents. Others will prefer to have a single agent to manage the sale of their property.
You can ask questions, seek independent advice, talk to more than one agent and negotiate what is written in the agency agreement. You can negotiate deadlines, commissions, expenses or services. Make sure you and your lawyer or intermediary are satisfied with the agreement before signing it. Real estate companies may have rules that allow their representatives to participate or not in open lists. For example, some companies do not advertise for open offers, but agents may be allowed to hire customers they already have as potential buyers. Real estate companies may be hesitant to work with public listings, fearing that the seller might find their own buyers anyway and close a deal without the participation of agents. This would make the efforts of the agents a waste of time and money. The seller could try to bypass the agents and develop a deal directly with their customers to cut them out of the loop.
